General Terms and Conditions

Ownership: All photographs, images, videos, and content created by Light House Media, including but not limited to real estate photography and videography, virtual tours, and any other related media, are the exclusive property of Light House Media

Content Alteration Restrictions: Images and videos may not be altered, edited, or manipulated in any way that would compromise the original artistic intent created by Light House Media. This is at the discretion of Light House Media.

Additional Usage: Any usage of the images or videos beyond the specified marketing purpose (including but not limited to commercial, editorial, portfolios, or promotional use) requires written permission from Light House Media. Additional fees may apply.

Ownership Acknowledgement: Light House Media retains copyright ownership of all media. Acknowledgment is not required for standard listing marketing purposes. However, if additional licensing is granted for uses such as portfolios, editorial publications, or social media campaigns unrelated to the specific listing, acknowledgment may be required as part of the terms of the additional licence.

Exclusivity: Unless otherwise agreed upon in writing, Light House Media retains the right to use the photographs and videos for self-promotion, portfolio, marketing, and any other purposes.

Termination of Licence: Light House Media reserves the right to terminate or modify the licence granted to the client in case of breach of these terms and conditions.

Governing Law: These terms and conditions are governed by the laws of Queensland, Australia, and any disputes will be resolved in accordance with those laws.

Matterport Virtual Tours: Matterport tours will be hosted until the property is sold, or with a maximum of 6 months. Once the hosting time expires, the client is responsible for any desired permanent media storage. Additional hosting is available upon request, and fees may apply.

Media Licensing Framework

Real Estate Media Licensing

Scope: The primary listing agent or agency is granted a non-exclusive, non-transferable licence to use the photographs, videos, floor plans, and virtual tours solely for the purpose of marketing the specific property depicted.

Duration: This licence is limited strictly to the duration of the active listing period for that specific campaign with that specific agent/agency.

Restrictions: Sub-licensing, selling, or transferring the usage rights to any third party (including builders, stagers, or subsequent agents) is strictly prohibited without express written consent from Light House Media, and may incur fees.

Commercial Event Media Licensing

Scope: Event clients are granted a perpetual, worldwide, non-exclusive Commercial Usage Licence for all delivered images. The Client is permitted to utilize the media indefinitely across all internal and external marketing channels, including company websites, social media channels, corporate presentations, advertising, and print collateral.

​​Restrictions: Copyright remains exclusively the intellectual property of Light House Media. The Client is prohibited from selling, sub-licensing, or transferring the media to third-party vendors, sponsors, or attendees without prior written agreement and potential additional licensing fees.

Event Scheduling, After-Hours, and Surcharges
To accommodate operations outside standard business hours and protect weekend scheduling, the following flat-rate surcharges apply to all Event media bookings. These fees stack cumulatively based on the scheduled timing of the event:

Standard Operating Hours: Monday to Friday, 7:30 AM to 5:00 PM (Base rates apply).

Weekend Surcharge: Any event scheduled on a Saturday or Sunday will incur a flat fee of $150 AUD.

After-Hours Surcharge (Post-5:00 PM): Any event booking that commences at, or extends past, 5:00 PM will incur a flat fee of $150 AUD.

Late-Night Surcharge (Post-8:00 PM): Any event booking that extends past 8:00 PM will incur an additional $150. Any event booking that commences at or beyond 8:00 PM will incur a flat fee of $300 AUD.
First Shoot Promotion

Light House Media offers new real estate agent clients a special "On the 'House'" promotion for their first booking. Choose from a 10-photo shoot, 5 drone photos, or a 2D colour floor plan for free (a $150 value).
Alternatively, enjoy $150 off any order above $150.

The promotion applies to your first order only and is limited to one offer per client.

The minimum booking amount is $150, in order to get the $150 off.

Trip fees and additional services are charged as normal.

Light House Media reserves the right to modify or withdraw this promotion at any time without prior notice.
Cancellations and Property Readiness

Cancellations: For Real Estate Bookings, appointments cancelled with less than 24 hours’ notice will incur a $100 cancellation fee. For Event bookings, cancellations within 48 hours will incur a flat $250 cancellation fee.

Getting Ready Guide:
Clients are strongly encouraged to review and utilize our Getting Ready Guide to ensure the property is prepared for the shoot. This guide provides valuable tips for making the home photo-ready, particularly if a professional staging company is not being used.

Weather-Related Reschedules:
Severe weather conditions, such as storms, heavy rain, or other unsafe circumstances, may require rescheduling. In these cases, no rescheduling or call-out fee will be applied. However, if the weather allows for interior-only shots, the client may choose to proceed with the interior shoot as scheduled.

Emergency-Related Reschedules:
In the event of unforeseen emergencies that are beyond the control of both the client and Light House Media—such as power outages, natural disasters, or other exceptional circumstances—reschedules will be accommodated without any additional fees.

Property Readiness and Rescheduling Fees: If the property is not ready upon the photographer's arrival, or if there are any preventable conditions (such as, but not limited to, locked properties, unready homes, or unexpected trades) that delay the shoot by 30 minutes or require rescheduling, the client will be subject to a $50 call-out/reschedule fee plus applicable travel fees.

Order Details & Accuracy

Square Metre Accuracy: Where required, the client is expected to have accurately entered or communicated all pertinent information at the time the order is placed. We reserve the right to update incorrect information and adjust the pricing of the order to reflect the correct details (e.g., if the client states the property is 130 m2 but it is actually 220 m2). Invoices will be adjusted accordingly.

Scope of Work: Our pricing reflects the cost for a residential listing. For commercial or multi-unit properties, please contact us for a personalised quote.

Travel Ranges and Fees: Travel is free within a 30 km one-way radius. For distances beyond the included radius, additional fees apply. Beyond our standard 30km radius, a fee of $30 is charged plus an additional $4/km one-way, between our launch (Pimpama) to destination. Standard travel fees are the first thing calculated online, and must be agreed to before proceeding with the booking.
Travel Fee Examples:
34km: $30 + $16= $46
40km: $30 + $40 = $70
46km: $30 + $64 = $94

​Travel to Islands: For properties located on islands off the East coast, additional travel fees apply. While the standard travel fee is automatically calculated during booking, it does not account for the extra time and expenses required for any required ferry transport. Light House Media will contact you with a finalised travel fee to accommodate for these additional costs. These bookings will only be confirmed once the finalised fee is approved.​

Oversized Scans and Floor Plan Fees
​
For properties exceeding standard size limits, oversized scan fees apply. These fees are determined by the total square metres scanned, not just the total living square metres. This includes all scanned areas such as walls, garages, alfrescos, or any additional spaces included in the scan.

These fees are in addition to standard pricing and reflect the increased time and resources required for larger properties. If the client provides inaccurate property size (or no size at all) during booking, any applicable oversized fees will be added to the final invoice based on the actual size scanned.

By placing an order, the client acknowledges and agrees to these fees being added when applicable, at Light House Media's discretion.

Limitation of Liability, Errors, and Omissions

Limitation of Liability: In the unlikely event of severe technical failure, equipment malfunction, data/memory card corruption, media loss, or unforeseen emergencies preventing Light House Media from delivering the agreed-upon services, the financial liability of Light House Media to the Client is strictly limited to a full refund of all monies paid for the specific booking. Light House Media shall not be held liable for any indirect, consequential, or incidental financial losses, missed real estate sales, or secondary event expenses incurred by the Client.

Errors and Omissions: While Light House Media takes extreme care to ensure accuracy across all floor plans, media files, dimensions, and virtual scans, all deliverables are provided as a marketing aid. Light House Media accepts no liability for minor technical discrepancies, omissions, or errors in architectural measurements. It remains the responsibility of the Client to review and approve all materials prior to publication.

Artistic Discretion and Key Moments: For all event coverage, Light House Media will execute the shoot utilizing professional artistic discretion. Due to the dynamic and unpredictable nature of live events, Light House Media does not guarantee the capture of specific individuals, specific guests, or singular unscripted moments.

Speaker System Hire Terms
​
1. Booking Fees & Security Deposit

$250: Initial 24-hour rental period fee.

$150: Additional fee charged per extra overnight or daily period thereafter.

$500: Maximum security deposit (bond) cap. The bond equals the total rental fee up to this maximum amount, and is payable via Bank Transfer or PayID payment prior to handover. Bonds are refunded in full within 2 business days of post-hire inspection.

Drop-off fees apply within our local service radius. Additional charges apply for extended distances, or requested equipment set-up. Pack-down and pickup may be available for additional fees as well, dependent on availability. Enquire to request.

2. Flexible Pickup, Return Windows & Late Fees

Scheduling & Flexibility: Light House Media aims to be reasonable and flexible with pickup and return times to accommodate event schedules (e.g., weekend wedding setups). Specific collection and return windows will be mutually agreed upon in writing prior to the event.

Late Return Fee: $150 will be applied if equipment is held beyond the agreed return window without prior written approval. This will be deducted from the security deposit or charged to the saved card on file.

Loss of Next Booking Liability: If an unauthorized late return directly causes Light House Media to lose or cancel a subsequent client’s confirmed rental, the Renter is liable for the full value of the lost booking in addition to standard late fees.

3. Stored Payment Methods & Off-Session Authorization

By agreeing to these terms, the Renter authorizes Light House Media to securely store their credit card details via Stripe.

The Renter explicitly authorizes Light House Media to process off-session charges against the saved card for:

Equipment damage, unreturned items, or loss exceeding the paid security deposit.

Applicable late return fees or loss-of-revenue penalties.
-
Extended hire downtime (demurrage) while damaged equipment is undergoing repair.

4. Equipment Care, Operations & Operational Boundaries

Inspection at Handover: The Renter acknowledges receiving all items listed in the Equipment Inventory Schedule in good working order. The Renter agrees to inspect the gear upon delivery/pickup and report any defects immediately.

Weather Protection: All electrical gear, mixing consoles, speakers, and cables must be strictly protected from rain, moisture, direct sunlight, and liquid spills. Gear must not be left outdoors overnight.

Separation of Services (A/V Technician Add-On): Equipment hire permits "dry hire" operation by the client. If Light House Media personnel are on-site for other services (e.g., event photography), staff are under no obligation to operate or troubleshoot the audio system unless an A/V Technician Service Fee has been explicitly booked.

5. Loss, Damage & Replacement Policy:

Inseparable Kit Rules: The Yamaha STAGEPAS 600BT system is rented as a single integrated unit. If a key component suffers irreparable physical or electronic damage, a standalone matching replacement cannot be sourced individually. The Renter is liable for the full replacement cost of the complete system. Other Grouped items including the Dual Wireless Microphone System, Eneloop Battery set, and Speaker Stand set, are also treated as matched kits. If individual parts are lost or damaged and cannot be replaced independently, the Renter is liable for the replacement cost of the entire set.

Severe Cosmetic Damage Fee: Standard wear-and-tear (faint scuffs from normal transport) is expected. However, if equipment suffers severe cosmetic damage—such as deep gouges, heavy scratching, bent metal grilles, or cracked casing due to impact or wind blow-over—that impairs its professional appearance for future premium rentals, a cosmetic depreciation fee of $150 to $300 will be charged per item to cover cabinet refurbishing, grille replacement, or loss of rental value.

Equipment Buy-Out Option: If a component suffers major cosmetic or structural damage to the point that Light House Media deems it unhireable for future premium clients, but the gear remains functional, the Renter may elect to "buy out" the damaged gear. Upon paying the full replacement cost of a new replacement unit or complete kit (e.g., $1,650 for the PA system), title to the damaged equipment transfers to the Renter, and they may keep the damaged unit.

Negligence & Outdoor Use: The Renter is solely responsible for securing equipment against environmental conditions, including weighting or sandbagging speaker stands outdoors. Damage caused by wind, rain, moisture, or tipping over is classified as Renter negligence and is fully billable.

Daily Out-of-Commission Fee (Demurrage): If equipment is returned damaged but repairable, the Renter is liable for the full cost of authorized repairs/refurbishment plus a daily fee of $150 for every day the equipment is out of service and undergoing repairs.

Cancelled Order & Lost Revenue Liability: If damage, non-return, or delayed return directly forces Light House Media to cancel or refund a subsequent client's confirmed booking, the Renter is liable for 100% of the lost booking revenue in addition to any repair, replacement, or demurrage fees.

By continuing to use our services, the client agrees to be bound by the most current version of the Terms and Conditions.
